Terms of Service

These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User”, “you” or “your”) and JYMOON GAMES DİJİTAL YAZILIM ANONİM ŞİRKETİ (“Jymoon”, “Company”, “we”, “us” or “our”).

By downloading, installing, accessing, playing or using our games, websites, applications and related services (collectively the “Services”), you accept and agree to be bound by these Terms.

You must be at least 13 years of age to use the Services. If you are between 13 and 18 (or the age of majority in your jurisdiction, whichever is higher), you may only use the Services with the consent and under the supervision of a parent or legal guardian who agrees to be bound by these Terms on your behalf.

By using the Services, you confirm that you meet these age requirements.

We grant you a personal, limited, non-exclusive, non-transferable, non-sublicensable and revocable license to access and use the Services solely for your personal, non-commercial entertainment purposes.

Any commercial use of the Services is strictly prohibited.

You are responsible for all activities that occur under your account. You must keep your account credentials confidential and secure.

• •Accounts are personal and may not be sold, rented, transferred or given away.
• •You may not create multiple accounts.
• •We may suspend or terminate your account in case of breach of these Terms, fraud, abuse, illegal activity, security risks, or where required by applicable law. Where reasonably possible we will provide notice, and your mandatory consumer rights under applicable law remain unaffected.

You agree not to:

• •Violate any applicable laws or these Terms
• •Harass, abuse, threaten, defame or harm any other user
• •Use cheats, hacks, bots, exploits, automation software or any unauthorized third-party tools
• •Attempt to reverse engineer, decompile, disassemble, modify or hack the Services
• •Scrape, harvest or collect data from other users
• •Sell, trade, transfer or exchange accounts, virtual items or in-game progress for real money or any external value
• •Impersonate any person or entity or create fake accounts
• •Upload or transmit unlawful, harmful, obscene, racist, violent, defamatory or infringing content
• •Interfere with or disrupt the Services or any servers
• •Use the Services for any commercial, advertising or promotional purposes

All virtual items, virtual currencies, boosters, skins and other in-game content (“Virtual Items”) are licensed, not sold. You receive only a limited, personal, non-transferable, revocable license.

• •Virtual Items have no real-world monetary value and cannot be redeemed for cash or cash equivalents.
• •Selling, trading, transferring, gifting or exchanging Virtual Items for real money or any external value is strictly prohibited.
• •All purchases are final and non-refundable, except where required by applicable consumer protection law (including, where applicable, the right of withdrawal for digital content under the EU Consumer Rights Directive and consumer rights under Turkish law). Refunds for purchases made through the Apple App Store or Google Play are also subject to the respective platform’s refund policies.
• •We may modify, adjust, remove or disable any Virtual Item at any time, subject to applicable law and your consumer rights.
• •If your account is terminated or suspended for breach of these Terms, any unused Virtual Items may be forfeited; for terminations not caused by you, your statutory rights remain unaffected.

All rights, title and interest in the Services, including all intellectual property rights, are owned exclusively by Jymoon or its licensors.

You have no ownership rights in the Services or any Virtual Items.

By submitting any content (chat messages, forum posts, images, etc.) to the Services, you grant us a worldwide, royalty-free, transferable and sublicensable license to use, modify, reproduce, distribute and display such content solely in connection with the operation, promotion and improvement of the Services.

You retain ownership of your content. The license ends when you remove the content from the Services, except to the extent it has already been shared with other users or retained for legal, security, fraud-prevention or back-up purposes.

We may suspend or terminate your access to the Services or delete your account in case of breach of these Terms, fraud, abuse, illegal activity, prolonged inactivity, security threats, or where required by applicable law. Where reasonably possible we will provide notice.

Your mandatory consumer rights under applicable law remain unaffected. You may also stop using the Services at any time by deleting your account.

To the maximum extent permitted by law, Jymoon shall not be liable for any indirect, incidental, special, consequential, punitive or exemplary damages.

Our total liability to you shall not exceed the total amount you paid to us during the twelve (12) months immediately preceding the claim.

Nothing in these Terms limits or excludes our liability for fraud, gross negligence, wilful misconduct, death or personal injury caused by our negligence, or any other liability that cannot be limited or excluded under applicable law.

The Services are provided on an “AS IS” and “AS AVAILABLE” basis, without any warranties of any kind, whether express or implied, including, without limitation, the implied warranties of merchantability, fitness for a particular purpose and non-infringement.

We do not warrant that the Services will be uninterrupted, error-free or free from viruses or harmful components.

We reserve the right to modify these Terms at any time.

We will notify you of material changes. Your continued use of the Services after the changes take effect constitutes your acceptance of the updated Terms.

Some provisions in these Terms may vary depending on your place of residence.

These Terms shall be governed by the laws of the Republic of Turkey.

Disputes arising from these Terms shall be subject to the jurisdiction of the courts of Istanbul. This does not affect any mandatory consumer rights you may have in your country of residence, including the right to bring proceedings before the courts of your domicile or, where applicable, before consumer arbitration boards (such as Turkish Consumer Arbitration Boards / Tüketici Hakem Heyetleri).
