1. PURPOSE

This Privacy Policy is incorporated by reference into the Terms of Service of JYMOON GAMES DİJİTAL YAZILIM ANONİM ŞİRKETİ. The terms “Jymoon”, “Company”, “we”, “us” and “our” refer to JYMOON GAMES DİJİTAL YAZILIM ANONİM ŞİRKETİ.

This Privacy Policy explains our online and offline information practices, including the types of personal data we may collect, how we collect such data, how we intend to use, store, protect, disclose, share, transfer or otherwise process such data, and how you may exercise your rights, opt out of certain uses or correct, delete or change certain information.

Jymoon is a digital game and technology company engaged in the design, development, operation, publication and commercialization of mobile games, applications and related online services. In the course of providing our games and related services, we may process personal data relating to our users, players, visitors, customers, prospective customers, community members, persons contacting us for support, persons participating in our campaigns, surveys, contests or promotions, and other individuals interacting with our Services.

This Privacy Policy is intended to provide transparent information regarding our privacy practices and to address privacy and data protection requirements applicable in Türkiye and, where relevant, in other countries and regions in which our Services may be accessed or made available, including G20 countries and regions, North America, Europe, the United Kingdom, Türkiye, the Asia-Pacific region, Latin America, the Middle East, Africa and other jurisdictions.

2. DEFINITIONS

For the purposes of this Privacy Policy:

“Personal Data” means any information relating to an identified or identifiable natural person, and includes any information that identifies, relates to, describes, is connected to, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular individual, device, household or user profile, to the extent such information is considered “personal data”, “personal information”, “personally identifiable information” or a similar term under applicable privacy and data protection laws.

“Processing” means any operation performed on Personal Data, including collection, recording, storage, retention, organization, use, disclosure, transfer, sharing, retrieval, classification, restriction, erasure, destruction, anonymization or any other operation carried out on Personal Data.

“Services” means Jymoon’s websites, landing pages and other online properties, each a “Site”, mobile games, mobile applications, online games, game-related platforms, forums, blogs, community pages, social features, user support channels, marketing and advertising activities, online or offline campaigns, events, surveys, contests, promotions, newsletters, in-game communications, push notifications and any other online or offline offerings operated by or on behalf of Jymoon from time to time, together with any and all future online and offline offerings, updates, features, expansions, downloadable content, virtual items, in-game events and related services made available by Jymoon or on behalf of Jymoon.

“Third Party” or “Third Parties” means any person or entity other than Jymoon and the user, including app stores, platform providers, social networking services, advertising networks, analytics providers, payment processors, cloud service providers, software development kit providers, business partners, service providers and other third-party websites, applications, tools or services.

“Social Networking Sites” or “SNS” means social media, social network, authentication or platform services, such as Facebook, Google, Apple, Game Center, Google Play Games or similar services, through which you may access, connect to, authenticate or interact with the Services.

“Software Development Kits” or “SDKs” means third-party or proprietary software components, libraries, tools or code integrated into our games, applications or Services, which may be used for purposes such as analytics, advertising, attribution, crash reporting, fraud prevention, anti-cheat, social login, payment verification or service functionality.

“Cookies and Similar Technologies” means cookies, pixels, web beacons, mobile SDKs, embedded scripts, local storage, device identifiers, advertising identifiers, logging technologies and other technologies that may automatically collect or store information through the Services.

3. SCOPE

This Privacy Policy applies to Personal Data that is Processed by Jymoon in the course of our business, including through the Services. This Privacy Policy applies regardless of whether you access the Services through a mobile device, tablet, computer, browser, app store, third-party platform, social media account, advertising campaign, link, website, SDK, application programming interface or any other online or offline method.

The Services may include features that allow users to create game accounts, save game progress, participate in teams, communities or multiplayer features, communicate with other users, appear on leaderboards, purchase virtual items, receive in-game offers, participate in campaigns, connect with SNS, receive advertisements, contact support teams or otherwise interact with Jymoon and other users.

All individuals whose responsibilities include the Processing of Personal Data on behalf of Jymoon are expected to protect such data by adhering to this Privacy Policy, Jymoon’s internal privacy and information security policies, applicable data protection laws, confidentiality obligations and relevant contractual commitments. Jymoon also expects its service providers and other Third Parties that process Personal Data on behalf of Jymoon to implement appropriate technical and organizational measures and to process such data only in accordance with applicable laws and contractual obligations.

This Privacy Policy is intended to meet privacy and data protection requirements globally, including those applicable in Türkiye, the European Economic Area, the United Kingdom, Switzerland, the United States, Canada, Brazil, Mexico, Argentina, Japan, South Korea, China, India, Indonesia, Australia, Saudi Arabia, South Africa and other G20 countries and regions, as well as other jurisdictions from which the Services may be accessed. Certain jurisdictions may provide additional rights or require additional disclosures. For this reason, this Privacy Policy includes general provisions applicable to all users and supplemental jurisdiction-specific provisions for certain countries and regions.

By visiting, installing, downloading, accessing, registering for, playing or otherwise using the Services, you acknowledge that you have read and understood this Privacy Policy. Where applicable law requires consent for specific Processing activities, including non-essential Cookies and Similar Technologies, targeted advertising, access to certain information stored on your device, electronic commercial communications, precise location data or international transfers, Jymoon will request such consent separately and in accordance with applicable law. Please do not install, access or use the Services if you do not agree with this Privacy Policy or the Terms of Service.

Please note that Jymoon is not responsible for the actions of Third Parties, the content of their websites, platforms, applications or services, the privacy practices of app stores, SNS, advertising networks, analytics providers, payment processors, SDK providers or other Third Parties, or the use of information that you provide directly to such Third Parties. If you access our Services from a Third Party application or connect our Services to any Third Party application, SNS, app store or service, you should also review the privacy policy and terms of use of that Third Party.

Jymoon reserves the right to modify, update or revise this Privacy Policy from time to time in order to reflect changes in our Services, technologies, business operations, legal obligations or privacy practices. If we make material changes to this Privacy Policy, we may notify you by posting the updated version on our Site or within the Services, by email, push notification, in-game notice or by any other method required or permitted by applicable law. Your continued use of the Services after the updated Privacy Policy becomes effective means that you acknowledge the updated Privacy Policy, unless applicable law requires a different form of notice, acknowledgement or consent.

This Privacy Policy does not apply to Jymoon’s job applicants, employees, interns, consultants, contractors, officers, directors or other personnel, unless expressly stated otherwise in a separate privacy notice provided to such persons.

Jymoon determines and is responsible for how Personal Data collected in connection with the Services is used, unless a Third Party acts as an independent controller under its own privacy policy. 5. TYPES OF PERSONAL DATA WE COLLECT AND HOW WE COLLECT IT

The types of Personal Data that Jymoon may collect, whether directly from you, automatically through your device or use of the Services, or from Third Party sources, and the manner in which such Personal Data is used may depend on the nature of your relationship with Jymoon, the Services you use, the features you choose to activate, your device and platform settings, your privacy preferences, your country or region, and the requirements of applicable law.

Some of the ways in which Jymoon may collect Personal Data include information that you provide directly to Jymoon when you create an account, play our games, participate in our Services, communicate with other users, contact us, request support, respond to surveys, participate in contests, campaigns or promotional activities, submit feedback, post content in forums or communities or otherwise interact with the Services. In addition, as you navigate, access or use the Services, certain information may be collected automatically through Cookies and Similar Technologies.

Jymoon endeavors to collect only such Personal Data that is relevant, adequate and necessary for the purposes of Processing described in this Privacy Policy, subject to applicable law.

5.1 PERSONAL DATA COLLECTED DIRECTLY FROM YOU

Account and profile information: When you create an account or player profile in our Services, we may collect information such as your name, username, in-game name, player name, email address, password, account ID, player ID, profile picture, avatar, country or region, language preferences, age or age range and other profile information. We use this information to create and manage your account, authenticate your access, save your progress, provide profile features, enable social features, provide support and deliver the Services.

Communications with us: When you request information about the Services, submit a support request, report a problem, ask a question, make a complaint or otherwise contact us, we may collect information such as your name, email address, phone number, mailing address, player ID, device information, purchase information, screenshots, correspondence, support ticket content, diagnostic information and any other information you choose to provide. We use this information to respond to your requests, provide support, troubleshoot technical issues, verify account or purchase information, investigate complaints and improve our Services.

User generated content: If you use chat features, forums, blogs, community pages, private messages, fan pages, social features or other interactive areas of the Services, we may collect the content that you submit, upload, post, transmit or otherwise make available. This may include messages, comments, posts, images, videos, screenshots, files, feedback, ratings, reviews, suggestions and other content. You should be aware that information you choose to disclose in public or semi-public areas of the Services may be visible to other users and may be used by them.

Survey, contest and campaign information: From time to time, Jymoon may run surveys, contests, campaigns, sweepstakes, tournaments, events or promotional activities. If you participate in such activities, we may collect contact information, player information, country or region, eligibility information, prize delivery information, survey responses and other information necessary to administer the relevant activity, deliver rewards or prizes, comply with legal requirements and, where permitted by law, send promotional communications.

Parental or guardian information: Where the Services include parental controls, age-gating, child safety features or consent mechanisms, we may collect limited information relating to a parent or legal guardian, such as a parent’s email address, consent record, PIN or verification information, only where necessary to activate, verify or manage the relevant feature and comply with applicable child privacy requirements.

5.2 PERSONAL DATA COLLECTED AUTOMATICALLY

Device and technical data: When you use the Services, we may collect information such as your unique device ID, persistent or non-persistent device identifiers, device model, device name, hardware type, operating system, operating system version, browser type, browser language, mobile carrier, internet service provider, IP address, app version, game version, SDK version, installation source, country or region settings, language settings and similar technical information. This information is useful for troubleshooting, security, analytics, fraud prevention, compatibility and understanding usage trends.

Advertising and platform identifiers: We may collect or process identifiers such as Identifier for Advertisers (“IDFA”), Identifier for Vendor (“IDFV”), Google Advertising ID (“GAID”), Android Advertising ID, Game Center ID, Google Play Games ID, platform user ID, app store identifiers, cookie identifiers and similar identifiers. These identifiers may be used for analytics, advertising, attribution, fraud prevention, purchase verification, social features, account management and service functionality, subject to your choices and applicable law.

Gameplay and analytics data: We may collect information about how you use and interact with our games, advertising and other Services, including game progress, levels, achievements, scores, rankings, missions, session duration, frequency of play, in-game events, gameplay choices, team or competition participation, virtual items, virtual currency, rewards, purchases, tutorials, feature interactions, ad views, ad clicks and other gameplay or usage information.

Crash, diagnostic and performance data: We may collect crash logs, error reports, diagnostic information, frame rate, latency, loading times, device performance data and other technical information about the performance of the Services on your device. We use this information to identify and fix technical issues, improve performance and optimize the Services.

Location data: We may collect approximate location information based on your IP address, device settings, app store region or country settings. We use this information to provide the Services in the correct language or region, comply with local legal requirements, prevent fraud, provide region-specific content or offers, conduct analytics and improve the Services. Unless expressly stated and separately consented to where required by law, we do not intentionally collect precise GPS-based location data.

Commercial information: We may collect information relating to products or services purchased, obtained or considered through the Services, including virtual items, virtual currency, subscriptions, downloadable content, purchase events, transaction IDs, receipt information, order status, refund status and other purchase-related information.

5.3 PERSONAL DATA COLLECTED FROM THIRD PARTIES

Most of the information that we collect about you comes directly from you when you play our games or interact with our Services. However, when you allow Third Parties to share information with us, or when such Third Parties have another legal right to share information with us, we may also collect Personal Data from Third Parties.

Third Party applications, app stores and platforms: If you download, install, access or play any of our games or use any of the Services through connected Third Party applications, app stores, platforms or services, Jymoon may receive certain information about you from the relevant Third Party provider. The information received depends on the Third Party application, your privacy settings and, where applicable, your friends’ or contacts’ privacy settings on that Third Party application.

Social Networking Sites and authentication services: When you connect with the Services through an SNS or other authentication service, the information that Jymoon may collect may include your name, username, social network user identification number, platform user ID, profile picture or profile picture URL, email address, age range, country, region, locale, language, time zone, friends list or information about friends who also use or are connected to the Services, and any other information that the relevant Third Party service makes available to Jymoon in accordance with your settings and permissions.

Payment processors and app stores: As part of payment processing through Third Parties, Jymoon does not generally collect, store or process full credit card numbers, bank account details or similar financial account information. Jymoon does not have access to your full credit card or bank account data where payments are processed by app stores or Third Party payment processors. However, such Third Party payment processors or app stores may share non-financial information with us relating to your purchases, such as the item purchased, transaction ID, receipt information, order status, purchase time, currency, country or region of purchase and other information necessary to verify, activate, restore, support or prevent fraud in relation to purchases.

Advertising, analytics and data partners: We may receive information from advertising networks, attribution providers, analytics providers, campaign partners and similar Third Parties, including information about installs, ad interactions, attribution, campaign performance, device identifiers, advertising identifiers, approximate location, interests, demographics, other games or services you use, and other information used to provide, measure or improve our Services and advertising activities.

You can manage certain information that Jymoon receives about you from a Third-Party application or platform by changing your privacy settings on the relevant Third-Party service. You can also manage some aspects of information collection and use by visiting the settings page of your mobile device and reviewing app permissions, advertising identifier settings, tracking permissions, notification settings and location settings.

5.4 SPECIAL CATEGORIES OF PERSONAL DATA

We do not intentionally request or collect special categories of Personal Data through the Services. Users should not submit special categories of Personal Data through chats, forums, support tickets or public areas of the Services.

If such data is submitted voluntarily or becomes necessary for a specific support request, legal obligation, safety issue, fraud prevention, anti-cheat investigation or rights protection matter, Jymoon will process such data only where permitted under applicable law and only to the extent necessary for the relevant purpose.

For users located in Türkiye, special categories of Personal Data will be processed only in accordance with Article 6 of KVKK and provided that the adequate measures determined by the Turkish Personal Data Protection Board are implemented.

6. HOW WE USE YOUR PERSONAL DATA

Our primary goals in collecting, storing and using your Personal Data are to provide a better gaming experience, operate and improve the Services, administer your use of the Services, personalize your experience, communicate with you, conduct analytics and research, deliver advertising and marketing where permitted, prevent fraud and cheating, protect the safety and integrity of our Services, comply with our legal obligations and enforce our rights.

We may use your Personal Data for the following purposes:

  • Providing and operating the Services: We use your Personal Data to provide, operate, maintain and make available our games, websites, mobile applications and other Services; to create and manage your account or player profile; to authenticate your access; to save and restore your game progress, scores, levels, achievements, rankings, virtual items and other in-game activity; to provide access to game features, social features, multiplayer functions, teams, competitions, leaderboards, events and other interactive elements; and to ensure that the Services function properly on your device and platform.
  • Personalizing your experience: We may use your Personal Data to personalize your gameplay experience, in-game content, offers, rewards, events, recommendations, language settings, user interface, difficulty levels and other features of the Services. This allows us to better understand our users and their preferences, improve user experience and provide more relevant game content.
  • Processing purchases and verifying transactions: If you make purchases through the Services, we may use purchase-related information received from app stores, payment processors or other Third-Party platforms to verify transactions, activate virtual items or paid content, restore purchases, respond to payment-related support requests, prevent fraud, process refunds where applicable and comply with tax, accounting and legal obligations.
  • Customer support and communications: We may use your Personal Data to respond to your comments, questions, complaints, feedback and support requests; to troubleshoot technical issues; to verify your account or purchase history; to investigate bugs, errors, crashes or performance issues; and to communicate with you regarding support matters. We may also send you service-related communications, including confirmations, technical notices, updates, security alerts, support and administrative messages, policy updates and other information relating to your use of the Services.
  • Improving and optimizing the Services: We may use your Personal Data and usage information to understand how users interact with our Services; to measure interest in our games and features; to conduct analytics, research and internal reporting; to test new features; to improve game design, performance, stability, security, user interface and user experience; to fix bugs and technical issues; and to develop new games, products, services and features.
  • Marketing, advertising and promotions: Where permitted by applicable law and subject to your choices, we may use your Personal Data to provide you with in-game offers, advertisements, campaigns, promotions, rewards, surveys, contests, events, newsletters, push notifications and other marketing communications that may be of interest to you. We may also use Personal Data to tailor content, advertisements and offers; measure advertising performance; attribute installs and in-app events; conduct market research; and improve our marketing activities.
  • Push notifications: We may occasionally send you push notifications through our mobile applications with game updates, high scores, rewards, reminders, events, offers, security alerts and other Services-related notifications. You may opt out of receiving push notifications at any time by changing the notification settings on your mobile device or, where available, through in-game settings.
  • Security, fraud prevention and anti-cheat: We may use your Personal Data to protect the security, fairness and integrity of the Services; to prevent, detect and investigate cheating, fraud, abuse, unauthorized access, account theft, payment fraud, harassment, violation of our Terms of Service or other prohibited activity; to moderate user generated content; to enforce our policies; and to protect our users, Company, rights, property and Services.
  • Legal compliance and protection of rights: We may use your Personal Data to comply with applicable laws, regulations, court orders, public authority requests, tax and accounting obligations, consumer protection rules ,data protection requirements and other legal obligations. We may also use your Personal Data to establish, exercise or defend legal claims, enforce our Terms of Service, resolve disputes, conduct audits, obtain legal advice, protect our rights and property and manage corporate transactions such as mergers, acquisitions, restructurings or asset transfers.
  • Anonymized and aggregated information: We may use Personal Data and other information about you to create anonymized, aggregated or de-identified information, such as aggregated gameplay statistics, device performance reports, advertising performance analyses, crash reports, user engagement trends and other internal reports. Such information is not intended to identify you and may be used for analytics, research, product development, business intelligence, service optimization and other lawful purposes.

7. LEGAL BASES FOR PROCESSING

The legal bases for Processing your Personal Data may vary depending on the purpose of Processing, the type of Personal Data involved, your country or region and the applicable data protection laws. We process your Personal Data only where we have an appropriate legal basis under applicable law.

  • Performance of a contract: We process certain Personal Data where it is necessary to provide the Services you request and to perform our Terms of Service. This includes Processing necessary to create and manage your account, provide gameplay, save progress, enable social and multiplayer features, verify purchases, provide customer support and maintain access to the Services.
  • Legitimate interests: We may process Personal Data where it is necessary for our legitimate business interests and where such interests are not overridden by your rights and interests. These legitimate interests include operating, improving and securing the Services; preventing fraud, cheating and abuse; conducting analytics and internal reporting; improving user experience; developing new games and features; enforcing our Terms of Service; communicating with users regarding service-related matters; and protecting our rights, users, business and Services.
  • Consent: In certain cases, we rely on your consent to process Personal Data. This may include Processing for certain marketing communications, targeted advertising, non-essential Cookies and Similar Technologies, access to certain information stored on your device, push notifications, precise location data, certain sensitive Personal Data or international transfers where consent is required by applicable law. You may withdraw your consent at any time through the relevant settings, consent tools, unsubscribe mechanisms or by contacting us.
  • Legal obligation: We may process Personal Data where necessary to comply with applicable laws, regulations, court orders, public authority requests, tax and accounting obligations, data protection requirements, consumer protection rules, sanctions, export control rules or other legal obligations.
  • Establishment, exercise or defense of legal claims: We may process Personal Data where necessary to establish, exercise or defend our legal rights, resolve disputes, enforce our agreements, investigate violations, respond to legal claims or protect the rights, property and safety of Jymoon, our users or others.

For users located in Türkiye, this Privacy Policy also serves as an information notice under Article 10 of KVKK. In this respect, Jymoon, as data controller, informs data subjects of the identity of the data controller, the purposes of Processing, the recipient groups to whom Personal Data may be transferred and the purposes of such transfers, the methods and legal bases of collection, and the rights of data subjects under Article 11 of KVKK.

8. DISCLOSURE OF YOUR PERSONAL DATA

We may share, transmit, disclose, grant access to, make available or otherwise provide your Personal Data to Third Parties in the circumstances described below. We disclose Personal Data for the purposes set out in this Privacy Policy, including to provide the Services, operate our business, comply with legal obligations, protect our rights and property and support our legitimate business purposes.

  • Other users and players: Social features may form part of our games and Services. Other users may see your profile information, username, in-game name, avatar, profile picture, scores, achievements, rankings, leaderboard position, team or clan membership, game activity, public messages, chat messages, posts or other content you choose to make available through the Services. If you connect the Services to an SNS, your friends or contacts on that SNS may also be able to see certain information about your use of the Services, depending on your settings and the features you use.
  • Service providers: We may share Personal Data with service providers that perform services on our behalf, including cloud hosting, data storage, analytics, crash reporting, diagnostics, customer support, payment verification, purchase restoration, fraud prevention, anti-cheat, security, advertising, attribution, campaign measurement, email delivery, push notification delivery, moderation, localization, legal, accounting, audit and other technical or business support services. These service providers are expected to process Personal Data only as necessary to provide services to Jymoon and in accordance with applicable laws and contractual obligations.
  • App stores and platform providers: If you download, purchase or access the Services through app stores or platform providers such as Apple App Store, Google Play, Game Center, Google Play Games or similar services, we may exchange information with such providers to verify purchases, restore transactions, enable platform features, authenticate users, provide achievements or leaderboards and comply with platform requirements.
  • Social media platforms and authentication providers: If you connect your account to Facebook, Google, Apple or another social media or authentication service, we may share and receive information necessary to enable login, social features, friend discovery, invitations, profile display and other connected services. Your interactions with such platforms are also governed by their own privacy policies and settings.
  • Advertising and analytics partners: Where permitted by applicable law and subject to your choices, we may share or make available certain information with advertising networks, mediation platforms, attribution providers, analytics providers and marketing partners. Such information may include device identifiers, advertising identifiers, IP address, approximate location, gameplay events, ad views, clicks, impressions, install source and purchase events. These partners may use such information to deliver and measure advertisements, perform attribution, prevent ad fraud, conduct analytics and provide advertising-related services.
  • Business partners and affiliates: We may share Personal Data with our affiliates, group companies, publishing partners, business partners or marketing partners where necessary for internal business purposes, joint campaigns, co-branded features, events, promotions, tournaments, research, analytics, service development or operation of the Services.
  • Legal authorities and protection of rights: We may access, preserve and disclose your Personal Data, account information, communications and content if we believe that doing so is required or appropriate to comply with applicable law, legal process, court orders, public authority requests, law enforcement requests or regulatory requirements; to protect the rights, property, safety or security of Jymoon, our users or others; to enforce our Terms of Service and policies; to investigate fraud, cheating, abuse, unauthorized access or illegal activity; or to establish, exercise or defend legal claims.
  • Corporate transactions: If Jymoon is involved in a merger, acquisition, financing, due diligence, restructuring, reorganization, bankruptcy, sale of assets, transfer of business or similar transaction, your Personal Data may be disclosed or transferred as part of or in preparation for such transaction, subject to applicable law.
  • With your consent or direction: We may disclose your Personal Data to Third Parties or publicly where you consent to or direct such disclosure, including when you choose to connect social accounts, share content publicly, participate in public competitions, invite friends, use social features or otherwise authorize sharing.

9. THIRD PARTY DATA COLLECTION AND ONLINE ADVERTISING

We may participate in interest-based advertising and use Third Party advertising companies, advertising networks, mediation platforms, attribution providers, analytics providers and social media platforms to serve advertisements, measure advertising performance, attribute installs and in-app events, understand user engagement, prevent ad fraud and improve our marketing activities.

Our advertising partners may collect information directly from your device when you use the Services through Cookies and Similar Technologies. This information may include your IP address, device type, operating system, advertising ID, country or region, language, app version, gameplay events, session length, ad impressions, ad clicks, install source, purchase events and other information relating to your interaction with the Services and advertisements.

12. INTERNATIONAL TRANSFER

Personal Data collected by or on behalf of Jymoon may be stored and processed in Türkiye and, where necessary for the operation of the Services, in other countries where Jymoon’s service providers, business partners, infrastructure providers, advertising partners, analytics providers, app stores, platform providers or other Third Parties operate. Such countries may include, without limitation, the United States, member states of the European Union, the United Kingdom and other jurisdictions in which our service providers or partners maintain servers, cloud infrastructure, technical support, advertising, analytics or other service operations.

Where Personal Data is transferred from Türkiye to another country, Jymoon will comply with KVKK, including Article 9 of KVKK and applicable secondary legislation. Accordingly, international transfers of Personal Data may be carried out where one of the legal bases for Processing under Articles 5 or 6 of KVKK exists and, in addition, where there is an adequacy decision regarding the relevant country, one or more sectors within that country or an international organization.

In the absence of an adequacy decision, Jymoon may transfer Personal Data abroad by relying on appropriate safeguards permitted under KVKK, provided that the data subject has the possibility to exercise rights and access effective legal remedies in the recipient country. Such appropriate safeguards may include binding corporate rules approved by the Turkish Personal Data Protection Board, standard contracts announced by the Board, written undertakings approved by the Board or other mechanisms recognized under applicable law. Where a standard contract is used, such standard contract will be notified to the Turkish Personal Data Protection Authority within five business days following its execution, to the extent required by applicable law.

Where neither an adequacy decision nor an appropriate safeguard is available, Jymoon may transfer Personal Data abroad only on an incidental basis and only in limited circumstances permitted under KVKK, including where the data subject has given explicit consent after being informed of the possible risks of the transfer, or where another derogation under KVKK is available.

For transfers from the European Economic Area, the United Kingdom, Switzerland or other jurisdictions with similar requirements, Jymoon may rely on adequacy decisions, standard contractual clauses, international data transfer agreements, binding corporate rules, transfer impact assessments, consent or other lawful transfer mechanisms recognized under applicable law.

13. DATA RETENTION

Jymoon retains Personal Data collected as described in this Privacy Policy for as long as you use the Services or as necessary to fulfill the purposes for which it was collected, provide the Services, resolve disputes, establish legal defenses, conduct audits, pursue legitimate business purposes, enforce our agreements and comply with applicable laws.
